1. Overview of Privacy Policy

Hello, and welcome to this Privacy Policy (“Policy). This Policy relates to the information Hyaroo (Hyaroo, also referred to as “we” or “us” or “our”) holds about you when you use our website (the “site”) and other media forms affiliated with it (collectively, our “services”). This Policy further describes our processing activities in relation to your information, including how we collect, use, share, and protect your information, and the rights that are available to you.

This Policy applies to you if you access or use the Site either as a client or worker and also as a visitor. You are required to read the provisions contained in it, understand it, and consent to it if you agree. If, however, you do not agree to it after reading it, you are not permitted to use the Site or our Services.

Hyaroo operates under XPONENT InfoSystem (PVT) LTD as your data controller with our server is hosted in the United States. By using the Site and our Services from your location, you consent to the processing of your information from our base of operation.

2. What information do we collect from you?

When you use the Site and the Services provided through it, we collect the following categories of information, which may be willingly submitted by you or automatically collected by us through programmed software:

2.1 Personal Information you willingly provide to Hyaroo

Depending on whether you use the Site as a worker or client, you may be required to submit some or all of this personal information to us: name, username and password, email address, phone number, physical address and zip codes, financial information, employment information, educational information, past project work, skills, qualifications, nationality, social profile link, website link, photos, instant messenger ID, etc.

This information may be collected through different means such as (i) when you request to sign up as a user on the Site, (ii) when you contact us through any of our contact information regarding inquiries, (iii) when you sign up to the Site through any social media plugin provided on the Site, (iv) when you take part in our surveys, promotions, sweepstakes, etc., (v) when you submit your ID for verification, and (vi) when you submit your financial information to process your payment or receive funds.

2.2 Information we collect automatically

We collect certain information about your use of the Site from your first or subsequent visits. This information is collected through our programmed software, and it includes the following:

  • Device Information: We collect information that cannot be directly used to identify who you are when you access the Site. This information includes your device IP Address, browser type, Operating System, and connection information.
  • Analytical Information: We collect analytical information about visitors on the Site. Analytical information is collected through a third party tracking tool known as Google Analytics. The information collected under analytics does not contain personal information. This includes information such as the number of traffic on the Site, the source of the traffic to the Site, the page viewed by each visitor, and the amount of time spent on the Site.
  • Aggregated Information: We may combine and share aggregated information with our third party service providers such as our social media providers, advertising partner, and analytics partner who may then combine it with other information they have about you when you use their services. Aggregated information is collected for the purpose of conducting general business analysis. This information may, for example, be shared with our third party service providers to reveal to them the number of visits made to the Site and the Site feature that is mostly used. This information will be for the development and improvement of the Site and its features.
  • Geo-location information: Hyaroo does not forcefully track or access your location if you do not permit it. However, when you visit the Site, we may use your IP Address to pin-point the location of your browsing device. This information is useful for general purposes such as to Enforce our Terms and Conditions or comply with applicable laws.

3. What do we use the information we collect for?

Whether you are a worker or client, the information we collect is for specific purposes, including to improve the Site, make your experience great, and fulfill our obligations to you. We use the information we collect to:

  • Identify you as a worker from other workers, evaluate you whether your skills or qualifications match what a client requests for, and for the client’s hiring processes;
  • Identify you as a client from other clients and provide the workers your information for them to apply to your job post based on their choices;
  • Contact you regarding updates, promotions, and to respond to your queries and complaints;
  • Verify if the information you shared with us is accurate and complete;
  • Process your payments for the jobs you posted as a client or pay you for your earnings as a worker;
  • Identify what features we need to improve on the Site and our Services;
  • Identify and tailor adverts to you based on your behaviors and preferences;
  • Enforce our Terms and Conditions and comply with relevant privacy laws set by privacy authorities and government agencies; and
  • Protect our rights, other users, and third parties, including to conduct investigations, prevent illegal activities such as fraud.

4. Cookies Policy

Like other websites, Hyaroo and third party service providers use cookies and other tracking software such as Facebook pixels, Adroll, Google Analytics, etc. to personalize the content on the Site, analyze traffic, save your preferences, provide social media, among other uses.

4.1 Cookies

Cookies are tiny pieces of data that are attached to your browser automatically through our programmed software to track some activities about you. Most of the cookies are set by Hyaroo while our third party service providers such as our analytics, payment processor, advertising companies set their own cookies to perform certain services on our behalf.

We use both the “session” and “persistent” cookies on the Site. While a session cookie, like its name, lasts for a session of your browsing time and expires when you close your browser, a persistent cookie stays for a definitive period and does not expire when you close your browser. Among other uses, cookies help us to save your preferences, monitor traffic, and personalize content based on your behavior.

You can choose to block cookies from being sent to your browsing device through the settings area of your browser or by using the help feature. However, we recommend that you allow cookies as not doing so may make some features unavailable to you or alter your browsing experience on the Site.

4.2 Tracking Pixels

We also use Pixels such as Facebook and Twitter pixels. Like cookies, Pixels are also attached to your browser when you visit the Site or when you open our email. Pixels help us to track some behaviors about you and conversion. We use Tracking Pixels to collect information regarding our online marketing, web analysis, or email marketing. It helps us to track the number of users that opened our email. To block us from tracking activities about you via Tracking Pixels, you can disable images from being loaded in any email you received from us.

4.3 Google Analytics

Google Analytics is a third party tracking software provided by Google Inc. that we use on the Site to gather analytics about the Site visitors. Google Analytics does not collect personal information, but the metrics and dimensions of traffic. Google Inc. uses cookies to track information such as the amount of traffic on the Site, the sources of traffic, the part of the Site each visitor is on, the number of content views, and the number of downloads on the Site.

You can disable Google Analytics from tracking you by downloading the Google Analytics Opt-out Add-on on your browser.

4.4 Do-not-Track

Most of the web browsers and some Operating Systems (“OS”) on mobile devices add a Do-Not-Track service or setting that you can activate to indicate your privacy preference not to store data about your online browsing activities monitored. Hyaroo does not currently respond to Do-not-Track signals.

5. When do we share your information?

Hyaroo does not share any information about you with third party for their marketing or personal use. Any information collected – whether automatically or willingly submitted by you – is for specific purposes, including to provide our Services and improve your experience on the Site. We do not share information unless it’s under the following circumstances:

5.1 When we contract Third Party Service providers

In some circumstances, we share personal information about you with our third party service providers (“Service Providers”) that perform certain activities for the Services. For example, in order to process your payments, we must collect your payment information and share it with our payment processing Service Provider to process such payments, including when a client pays for a contract and when a worker gets paid their earnings. Other Service Providers may include but are not limited to our analytics, fraud detection, marketing, maintenance, and website improvement partners.

Please be aware that Service Providers are under a strict obligation – through contract – to only use personal information for the provision of our Services. They do not have permission to use your information for their personal use.

5.2 When it is required by law

When it is appropriate, we will share information about you if it is requested by law enforcement or government agencies, including for the investigation of claims or disputes. The information that may be shared under legal requirements may include your transactions and relevant deals. The sharing of information as required by law may also occur when we believe sharing it will prevent our rights, other users, and third parties against claims or fraudulent acts.

5.3 When there is a Business Transfer or Bankruptcy

A business transfer may include actions such as a sale of assets, merger, acquisition, or consolidation between Hyaroo and other entities. We may also share information – as part of due diligence – when there is a bankruptcy action. When any of the foregoing occurs, we are required to share personal information with the entity(s) concerned.

5.4 When you participate in Sweepstakes and Promotions from Sponsors

If you register with any sweepstake, contest, or promotion that is sponsored by a third party, your personal information that is submitted during your registration will be shared with the relevant sponsor of such event.

5.5 When you consent to it

In certain circumstances, you may direct us to share information about you with a third party. in this case, we will have no choice but to grant your request.

6. User Postings

Certain areas of the Site and Services will permit you to post content on the Site, including but not limited to, listing jobs as a client, send proposals as a worker, giving feedback as a client or worker, and posting comments on blogs or our community (collectively “User postings”). You are aware that some of your personal information will be attached to your User Postings, which will be visible to anyone using the Site and the internet through a search.

7. How secure is your information?

Hyaroo is dedicated to safeguarding your information from theft, alteration, and unauthorized access or use. We are aware of the value attached to your personal information and the loss you may suffer if it gets into the wrong hands. Due to this, we have put both physical and technical measures in place to safeguard it from third parties or unauthorized access. For one, we do not share personal information under any circumstances unless as described under section 5 above and we do not share your contact information with third parties for their marketing purposes. Also, we use the industry’s best SSL (Secure Socket Layer) Encryption in safeguarding information on our server. This means that when you enter sensitive information on the Site, the transmission of such information is encrypted.

However, you agree with Hyaroo that no matter how sophisticated the measures we take are, it may not be enough to counter or arrest every threat to your personal information. Hyaroo will not be liable for any bypassing of your information from theft.

8. Hyaroo Communications

When you submit your contact information such as your email address during registration, you will automatically be added to our email marketing and other communications list, including communications about offers, bonuses, new products, and updates (collectively, “Hyaroo Communications”). Hyaroo Communications will be sent to your email address as a campaign for as long as you are subscribed and do not opt-out. However, you may opt-out of Hyaroo Communications by clicking the “unsubscribe” link attached to any Hyaroo Communication sent to your email address. Please, be aware that if you opt-out of Hyaroo Communications, it may not apply to administrative messages such as updates or changes to our Services or this Policy and other agreements.

9. Do we transfer your information to other countries?

Hyaroo provides the Site and our Services from our base of operation in Bangladesh, Asia, where we process your information from. However, some of our Service Providers and partners are located in the United States and other countries or locations where the privacy laws may not be as adequate as that of your location.

When you submit personal information to us, it will be processed on our server in the United States and the locations where our Service Providers perform their services from. However, when we share information with our Service Providers, the use will be in accordance with this Policy.

For users in the EU and EEA communities, we will ensure that any information collected from you will be processed in Bangladesh, the United States, and other locations in accordance with the GDPR law.

10. User Rights and Choices

As a User of the Site, you have the following rights and choices regarding your information and our processing practices:

  • Right to correct your information: You may correct certain information about you through your account profile, including your name, address, and contact information. However, you cannot edit certain information such as your ID, transactions with clients, and other communications. This is to comply with the law and enforce our Terms and Conditions. You may also send us a message via info@hyaroo.comto exercise this right or use the “Contact Us” section of the Site.
  • Right to the deletion of information: Also, you have the right to delete your user account at any time by using the delete account feature in your profile area. If you delete your account, all the information we hold about you will be deleted from our server except for some certain non-personal information such as your transactions, IP address, and communications. This is to comply with applicable laws and protect our rights against future claims and disputes.

For users in the EU and EEA communities, you may have, in addition to the above rights and choices, other rights such as (i) demanding us to restrict the processing of certain information about you, (ii) requesting us to stop the processing of certain information, (iii) asking us to provide information about who we have shared information about you with.

11. How long do we store your information?

How long we keep information depends on the type of information involved. For information such as the verification ID you submitted, it stays on our server for 30 days before we deleted it. For other personal information such as your name, email address, and related information, they remain on our server for at least 5 years before we deleted them. However, if you decide to exercise your right to deletion of information as defined in section 10 above, we will delete this information within 24 hours.

We Notwithstanding the above, we may keep information about you in backup copies for business continuity purposes for longer periods than what is stated.

12. Do we collect personal information from Children?

No, we do not permit visitors that are below 18 years of age or 16 in certain countries (collectively “Minors”) to submit personal information to us and use the Site. If you are a Minor, you may only use the Site with the involvement of at least a parent or legal guardian.

13. Third Party Links

There may be third party links or content linking to another website on the Site (“Third Party Links”). That Third Party Links are found on the Site does not mean we control or endorse any content found on the applicable websites. When you access any Third Party Link through the Site, we recommend that you read the privacy policy of the website such Third Party Links connects to. Hyaroo will not be responsible for any loss you may suffer from any Third Party Link you access via the Site.

14. Changes to this Policy

This Policy is subject to review and changes – may be due to changes in applicable law or our Services. Any such changes to this Policy will take effect when the Effective Date above changes. You may be notified of changes to this Policy through your registered email address; therefore, you are expected to have access to your email address all the time. You are also expected to review this Policy on frequent occasions to watch out for changes to it. When you continue the use of this Site and our Services after any changes to this Policy, it constitutes your acceptance of any such changes.
